The first option is a formal dissolution of marriage, and second option is known as a simplified dissolution of marriage. This document set contains all the documents necessary for a formal dissolution of marriage, except for the Marital Settlement Agreement, which is sold separately. WHO MAY USE THIS DOCUMENT SET: This document set is appropriate if you are seeking a no-fault agreed uncontested divorce. You and your spouse must agree on all of the terms of your divorce. If you and your spouse have any jointly owned property or jointly held debts, you must agree to their division or allocation. Either you or your spouse must have resided in Illinois for at least ninety (90) days immediately prior to filing. Your marriage must be irretrievably broken, and no reasonable likelihood may exist that your marriage can be restored. You and your spouse must have lived separate and apart for at least six (6) months. You and your spouse may have been married for any number of years. (If you are seeking a simplified dissolution, i.e. you have been married less than eight (8) years, you and your spouse's combined annual income is less than $35,000, and the total value of you and your spouse's jointly owned property (minus debts) is less than $10,000, then you should purchase our simplified joint petition, as well as the simplified judgment, instead of this document set.)
