Important Arkansas recording notes

  • Arkansas deeds are recorded with the Circuit Clerk in the county where the property is located.
  • Arkansas real property transfer tax can apply to transfers over $100 unless an exemption applies.
  • Homestead, dower, curtesy, spouse-signature, marital-status, and capacity issues can affect whether a conveyance is effective.
  • Use the complete legal description from a reliable title source; a street address or parcel number alone is usually not enough.
  • Grant, statutory-warranty, TOD, correction, easement, fiduciary, and other specialty paths remain gated unless separately approved.

How to choose

Ordinary sale or lender/title-insurance transaction

Arkansas warranty deeds are the customary starting point when warranty protection is intended.

Family, trust, divorce, or title-clearing transfer

A quitclaim deed may fit known-party transfers where no deed warranty is intended.

Specialty or statutory-warranty treatment

Use professional help for grant-label, statutory-warranty, fiduciary, correction, or other nonroutine deed issues.
