What Is a Texas Correction Deed / Correction Instrument?

A Texas correction deed is commonly searched by that name, but the recordable form in this package is a Texas Correction Instrument. It is designed for narrow nonmaterial corrections under Texas Property Code sections 5.027 and 5.028. It is not a new conveyance, does not convey title, and should not be used to change the bargain or fix a material title problem.

What Is Included After Checkout?

The package includes two editable Microsoft Word documents: the Texas Correction Instrument and a separate Texas Correction Instrument Instructions and Checklist. The instruction file is separate so completion guidance is not accidentally recorded as part of the instrument.

Nonmaterial Correction Only

This form is for clerical or inadvertent errors that fit the nonmaterial correction path, such as certain errors in legal descriptions, party-name details, marital-status recitals, execution dates, recording references, acknowledgment facts, or omitted calls described by statute. Texas Property Code section 5.028 requires the person executing the correction instrument to disclose the basis for personal knowledge, and notice rules can apply when not all parties to the original instrument sign.

Do Not Use for Material Corrections

Do not use this packet if the correction may add or remove land, change the conveyed interest, change a grantee or ownership share, add a buyer disclaimer, add mortgagee consent or subordination, identify a different lot or unit, affect foreclosure or lien rights, or otherwise materially affect title. Material corrections under Texas Property Code section 5.029 require a different execution path and Texas counsel or title-company review.

Texas Recording and Completion Notes

  • Confidentiality notice: The correction instrument includes the Texas confidentiality-rights notice at the top of the first page.
  • Personal knowledge: The executing person must disclose the basis for personal knowledge as required by section 5.028(c).
  • Notice: If each party to the original instrument does not execute the correction instrument, section 5.028(d) notice and evidence-of-notice issues must be reviewed carefully.
  • Recording office: Record the correction instrument and any required evidence in each Texas county where the original instrument is recorded.
  • Title-company acceptance: Statutory compliance and title-company acceptance are not the same thing. Many title companies prefer all affected parties to sign even for nonmaterial corrections when feasible.

Frequently Asked Questions

Does a Texas correction instrument convey property?

No. A nonmaterial correction instrument corrects the original recorded instrument and conveys nothing. It is not a substitute for a new deed when a new conveyance is required.

What is the difference between nonmaterial and material correction?

Nonmaterial corrections under section 5.028 address listed clerical or inadvertent errors. Material corrections under section 5.029 can affect title or the conveyed interest and require a different execution path by the parties to the original instrument or their successors. Use counsel or title-company review when unsure.

Who signs a Texas nonmaterial correction instrument?

A person with personal knowledge of facts relevant to the correction may execute a section 5.028 nonmaterial correction instrument, but the basis for personal knowledge must be disclosed. Title-company practice may still prefer signatures from all affected parties.

Where do I record a Texas correction instrument?

Record it in each Texas county where the original instrument being corrected is recorded, along with any required evidence of notice when not all original parties sign.

What files are included with this Texas correction product?

The product includes the editable Texas Correction Instrument Word document and a separate editable Texas Correction Instrument Instructions and Checklist Word document.
