Tennessee Deed Forms

Tennessee deed selection should account for general warranty or quitclaim wording, acknowledgment, source-of-title and parcel requirements, transfer-tax oath/value statements, and homestead or survivorship issues.

Recommended for many Tennessee sale transfers

Tennessee Warranty Deed

A Tennessee warranty deed path for transfers where general warranty treatment is intended.

Best fit
  • ordinary arm's-length sales
  • title-insurance and lender transactions
  • general warranty treatment
Watch for
  • transfer-tax oath/value, source-of-title, parcel, and tax-bill mailing requirements are separate recording issues
  • homestead, survivorship, or tenancy-by-entirety facts may require attorney or title review

Available for selected no-warranty transfers

Tennessee Quitclaim Deed

A Tennessee quitclaim path for selected transfers where the grantor conveys whatever interest the grantor has without a warranty of title.

Best fit
  • family transfers
  • trust funding
  • title-clearing
  • divorce-related transfers
Watch for
  • not the customary deed for many arm's-length sales
  • provides no warranty of title
  • actual-consideration tax, oath/value, and recording requirements may still apply

Tennessee Grant Deed

Tennessee does not have an approved PublicLegal grant-deed product path in this wave; use warranty, quitclaim, or professional drafting based on intended covenant scope.

Best fit
  • comparison only
Watch for
  • do not link the inactive Tennessee grant-deed URL as a product
  • special/limited warranty treatment would be a separate future product decision

Tennessee Special / Limited Warranty Deed

Tennessee special or limited warranty treatment can be valid for some transactions but is not currently a PublicLegal self-service product.

Best fit
  • bank, REO, new-construction, fiduciary, or limited-covenant transfers with professional support
Watch for
  • not a current PublicLegal self-service product
  • use attorney or title-company help for covenant-scope decisions

Tennessee Transfer-on-Death / Lady Bird Deed

Tennessee does not currently provide a PublicLegal transfer-on-death or Lady Bird deed path for real property.

Best fit
  • estate-planning review with counsel
Watch for
  • use a Tennessee attorney for probate-avoidance, trust, life-estate, or survivorship planning

Use Tennessee attorney, title, tax, or register support

Specialty deed issues

Correction, fiduciary, probate, tax, capacity, title-defect, mineral, easement, source-of-title, and other specialty deed issues require individualized help.

Watch for
  • use a lawyer, title company, tax professional, County Register, court, or agency path for specialty facts

Important Tennessee recording notes

  • Tennessee deeds are recorded with the County Register of Deeds in the county where the property is located.
  • Most Tennessee deeds are acknowledged before a notary or other authorized officer; the alternative proof route involves two subscribing witnesses.
  • Freehold transfers can require a face-of-instrument oath or affidavit of value, source-of-title recitals, parcel information, preparer information, and grantee/tax-bill mailing information.
  • Realty transfer tax, indebtedness tax, exemptions, and grantee/transferee payer rules are separate recording and tax issues.
  • Grant, special/limited warranty, TOD, Lady Bird, correction, fiduciary, mineral, and other specialty paths remain gated unless separately approved.

How to choose

Ordinary sale or title-insurance transaction

A Tennessee warranty deed is the PublicLegal starting point when general warranty treatment is intended.

Family, trust, divorce, or title-clearing transfer

A Tennessee quitclaim deed may fit selected known-party transfers where no warranty of title is intended.

Tax-oath, source-of-title, homestead, or specialty facts

Use attorney, title, tax, or County Register support for transaction-specific recording and drafting questions.

PublicLegal scope

Self-help scope

PublicLegal self-help guidance for customer-completed deed forms — not legal advice or a substitute for Tennessee attorney, title, tax, or County Register review.
