Yes. Both spouses sign the official Marital Settlement Agreement (CC-DR-116). The agreement may provide for the merger or non-merger of its terms into the decree - the official form asks the court to incorporate but not merge it. The court must accept the agreement and, when children are involved, be satisfied that its terms serve the children's best interests.
