Yes. Both spouses must sign the separation agreement, and §1A requires the signatures to be notarized. The court must find the agreement fair and reasonable and not the product of fraud or coercion. Child custody and support terms always merge into the judgment and remain reviewable (G.L. c.208, §28); property and alimony terms elect to merge or to survive as an independent contract.
