SEPARATION AGREEMENT (MARITAL SETTLEMENT AGREEMENT) — WITHOUT MINOR CHILDREN (PublicLegal-authored). The PublicLegal-authored Montana agreement both spouses sign to settle property, debts, and maintenance when they agree on every issue. Montana publishes no official statewide settlement form.
What it records: an equitable apportionment of all property and debts — including premarital property, gifts, and inheritances — with itemized schedules (Mont. Code Ann. § 40-4-202), maintenance or waiver (§ 40-4-203), and tax terms.
Before you sign: each spouse must serve the final declaration of disclosure (§ 40-4-253) and file the certificate of service (§ 40-4-254) — the court may not enter a property judgment without it.
Signing does not divorce you: the agreement must be incorporated into the decree the judge signs. The full filing packet is a separate product.

Yes. Both spouses sign the PublicLegal-authored Separation Agreement — Montana publishes no official statewide settlement form. Before or at signing, each spouse must serve the final declaration of disclosure (§ 40-4-253) and then file the certificate of service (§ 40-4-254); the court may not enter a property judgment without it. The court may incorporate the agreement into the decree (§ 40-4-201). Signing the agreement does not divorce you - the judge does.
