About this form
This agreement records the terms both spouses have agreed to, so the final decree can incorporate them.

MARITAL SETTLEMENT AGREEMENT (official Form 4A-301 NMRA). The official New Mexico Supreme Court agreement both spouses sign to settle property and debts when they agree on every issue. It must be filed in every New Mexico dissolution; free blank at nmcourts.gov.
Community and separate property: New Mexico is a community-property state (§ 40-3-8), so the agreement characterizes and divides both community and separate property and debts (§ 40-4-7), with Attachment A (personal property) and Attachment B (real property).
Notarized; not a divorce by itself. Both spouses sign before a notary. Signing it does not end the marriage — the judge must still sign the Final Decree (4A-305), sold separately.

This form works when both spouses have reached full agreement. If you disagree about property, debts, custody, or support, mediation or attorney help is the safer path before filing.
No. ILRG provides self-help legal forms and information, not legal advice. Consult a New Mexico attorney if you have significant assets, debts, or any disagreement about the settlement terms.
