A complaint may be filed after either spouse establishes Connecticut residence. A decree may enter only if one spouse has been a Connecticut resident for the 12 months next preceding filing or the decree; or one spouse was domiciled here at the marriage, moved away, and returned with the intention of remaining permanently before filing; or the cause arose after either spouse moved into Connecticut (C.G.S. § 46b-44). File in the Superior Court for the judicial district where one of you resides. Confirm the district with the clerk.
This packet uses Connecticut’s no-fault ground that the marriage has broken down irretrievably (C.G.S. § 46b-40(c)(1)). One spouse files official JD-FM-159. This packet is not the separate nonadversarial joint-petition path.
There is no mandatory 90-day wait for an ordinary uncontested case. Public Act 23-46 deleted that old rule. Unless the spouses reach a full agreement and ask the court to enter judgment before the return date, the court may proceed following the second day after the return date (C.G.S. § 46b-67(a)). Default after personal or abode service waits at least 30 days; other service waits for a hearing at least 60 days. Court schedules vary by judicial district.
No. This packet is built for uncontested cases where both spouses cooperate, usually by signing official JD-FM-172 and filing appearances. If your spouse will contest the case, consult a Connecticut attorney. A contested trial cannot start until at least 90 days after the return date.
No. ILRG provides self-help legal forms and information, not legal advice. Consult a Connecticut attorney if you have significant property, retirement accounts, business interests, safety concerns, or any disagreement about terms.
