About this form
This is a no-fault divorce form for use within the State of Michigan (COMPLAINT FOR DIVORCE). Most courts will require that this form be completed and filed along with a Marital Settlement Agreement. Please note that in Paragraph 5 (Grounds for Divorce), the Plaintiff will need to specify grounds for divorce that are recognized as valid within the State of Michigan. Michigan law recognizes only the following grounds as sufficient for granting a no-fault divorce: A breakdown of the marriage relationship to the extent that the objects of matrimony have been destroyed, and no reasonable expectation exists that the marriage can be preserved.
Michigan generally requires 180 days of state residency and 10 days in the county before filing, and a no-children divorce cannot be finalized until at least 60 days after filing (MCL 552.9, MCL 552.9f). The FAQ below covers the details.
See page 1 of the actual blank form and review a plain-language outline. The complete formatted documents are delivered after checkout.
COMPLAINT FOR DIVORCE (NO MINOR CHILDREN). This is the filing that opens an uncontested no-fault divorce in a Michigan circuit court.
Caption: the court, county, case number, and judge, plus each spouse's name, address, and telephone number as court rules require.
Residency and jurisdiction: checkboxes that establish the Michigan and county residency the law requires, including the special one-year rules that apply when the breakdown happened outside Michigan or a spouse lives out of state.
Marriage and breakdown: the date and place of the marriage and the no-fault statement that the marriage has broken down with no reasonable likelihood of reconciliation.
Property, support, and name: elections for how property and debts are handled, whether spousal support is waived or reserved, and an optional restoration of a former name.
The full packet also includes the summons, default and hearing forms, the judgment of divorce, the joint-petition (consent) path, official state court forms, and step-by-step instructions.

Michigan generally requires that at least one spouse has lived in the state for the 180 days immediately before filing and in the county of filing for the 10 days immediately before filing (MCL 552.9). If the breakdown occurred outside Michigan, one spouse must have lived in Michigan for one year (MCL 552.9e); additional conditions apply if the defendant was not domiciled in Michigan (MCL 552.9f).
Michigan is purely no-fault. The court may grant a divorce when the marriage relationship has broken down to the extent that the objects of matrimony are destroyed and there is no reasonable likelihood the marriage can be preserved (MCL 552.6). The complaint in this packet includes that ground.
Michigan courts cannot finalize a divorce without minor children until at least 60 days after the complaint is filed, and a judge cannot shorten that period in a no-children case (MCL 552.9f). Court schedules vary by county.
