Who files: a parent or guardian files the Petition for Minor’s Name or Sex Change (1720FA) in the district court of the county where the child has lived for at least one year (§ 42-1-1). For a name change you complete only the name-change paragraphs (¶12, then ¶20) and skip the sex-designation items — the 9000XX guardian-ad-litem order in the packet is for a minor legal-sex change only. The filing fee is $375 (§ 78A-2-301(1)(a)).
The other parent — a required fork: for each parent, and any guardian, conservator, or guardian ad litem entitled to notice (1720FA ¶20), a consenting parent signs the Consent (1721FA), or a non-consenting parent is served under Utah Rule of Civil Procedure 4 with the Summons (1712FA in-state / 1713FA out-of-state), the petition, and the Notice of Hearing (1722FA) — then proof of service is filed. A parent who cannot be found may be served by alternative service.
Notary, publication, and after: petition and consent signatures are notarized only in Juab, Millard, Utah, and Wasatch counties; Utah County filers deliver to the Provo courthouse. There is no routine publication (§ 42-1-2). After the judge signs the Order (1723FA), amend the child’s birth certificate with a certified order at the Office of Vital Records and update the child’s Social Security record, passport, and school and medical records.
