What you receive for New Jersey

A practical New Jersey lease packet built to document the rental relationship, Anti-Eviction Act coverage, deposit and identity-disclosure duties, and the companion notices listed below.

Built around New Jersey Anti-Eviction Act requirements

The lease is organized around New Jersey Anti-Eviction Act and related landlord-tenant rules, with deposit limits, identity-disclosure, and statutory terms written into numbered sections of the agreement itself — see the section guide below.

Editable self-help files

Download the files, customize lease terms on your own device where Word format is included, and keep a signed copy for your records.

Edit in Word or print the PDF

Use the editable Word file to customize the lease on your own device, or print the PDF for a consistent signing copy. No online interview or ILRG account is required.

New Jersey statutory integration

Inside each agreement: a 12-page, 53-section lease with the New Jersey provisions built in — not stapled on

New Jersey-specific terms, disclosures, and acknowledgments are organized into numbered lease sections, with completion fields where needed. Separate disclosure materials must still be provided when applicable.

  1. Guided Data Schedule Front-page schedule captures parties, premises, dwelling type (which drives the § 1 condo/co-op statement), the lease-for-term or month-to-month election, Anti-Eviction Act Covered/Exempt (unchecked is treated as Covered), the 1.5× deposit cap, depository fields, and notice addresses.
  2. §§ 1–3 Condo/co-op statement, term, Anti-Eviction Act § 1 incorporates the N.J.S.A. 2A:18-61.9 conversion/sale statement as the first clause when the dwelling type is a condominium or cooperative. § 2 is the term election; § 3 states Anti-Eviction Act coverage and the Data Schedule default.
  3. § 5 Security deposit If the Rent Security Deposit Act applies, combined deposits may not exceed 1.5× monthly rent (N.J.S.A. 46:8-19), with depository notice fields in the Data Schedule, a 30-day itemized return, and an optional January 31 interest-payment election.
  4. § 45 Identity of landlord and agents Thirteen registration fields under N.J.S.A. 46:8-27 et seq. (owner, agents, emergency contact, mortgage holders, fuel-oil dealer when oil heat is furnished), plus the filing/posting sentence.
  5. §§ 40, 49, 51–53 Window-guard notice, Truth in Renting, addenda, flood § 40 prints the N.J.A.C. 5:10-27.1 window-guard notification in the lease; it is not the verbal notice or the separate acknowledgment. § 49 is a tenant acknowledgment of receipt of the official Truth in Renting statement — not the statement itself. § 51 is an attach-checklist; § 53 points to the separate Flood Risk Notice rider required by N.J.S.A. 46:8-50.

Applicability varies. The window-guard notification applies only to covered multiple dwellings under N.J.A.C. 5:10. Truth in Renting applies to the covered multi-unit tenancies in § 49; the official DCA booklet is included in this packet and must still be given to the tenant. Lead-based paint materials apply to covered pre-1978 housing and are delivered separately in the packet; Exhibit A is the landlord’s lead-safe certification (or exemption basis), supplied at signing. The Flood Risk Notice rider, window-guard acknowledgment, and landlord rules are not included in this lease packet; the landlord must furnish those materials when they apply. The steam-radiator notice is included in the packet for premises with uncovered steam radiators.

New Jersey sublease planning notes

Start with the original lease before subletting in New Jersey. State guidance treats subletting and assignment restrictions as lease provisions to review.

If approval is required, get it in writing; if the lease is silent, document the arrangement carefully and keep in mind that the original tenant usually remains responsible to the landlord.

  • Review the lease for subletting or assignment restrictions.
  • Check local rules where applicable.
  • Keep any landlord consent and the signed sublease with your records.

Most leases require written landlord consent before subletting. Review the original lease and obtain any required approval before using the completed sublease agreement.

The original tenant commonly remains responsible to the landlord unless the landlord separately releases them. The sublease documents the subtenant arrangement, but it does not automatically end the original tenant’s obligations under the main lease.

No. ILRG provides self-help legal forms and information, not legal advice. You are responsible for reviewing the completed sublease, original lease, and landlord-consent requirements before signing.

New Jersey guidance points tenants to the lease for subletting and assignment restrictions. If your lease requires consent, get that consent in writing before the subtenant moves in.
