What Is an Oklahoma Quitclaim Deed?

An Oklahoma quitclaim deed uses the words "quitclaim, grant, bargain, sell and convey." It transfers whatever interest the grantor holds at delivery, if any, and carries no warranty of title. If the grantor does not own the property, or if there are liens against it, the grantee takes subject to those issues.

When to Use a Quitclaim Deed in Oklahoma

Quitclaim deeds are commonly used for low-warranty transfers where the parties already know each other and understand there are no title covenants. Common uses in Oklahoma include:

  • Transferring property between family members, such as a parent to a child, after homestead-joinder review.
  • Adding or removing a spouse from title after marriage or divorce.
  • Moving real estate into a living trust or an LLC owned by the grantor after title-company review.
  • Clearing a cloud on title, such as correcting a misspelled name on a previous deed, where the parties do not intend the five 16 O.S. § 19 warranty covenants.

Oklahoma Requirements for Quitclaim Deeds

  • Signing: The grantor must sign. A homestead conveyance generally requires both spouses to sign or the deed is not valid (16 O.S. § 4). Oklahoma is not a community-property state. If title is held as tenants by the entirety, both spouses must sign as grantors.
  • Notarization: Each executing signature must be acknowledged before a notary public. Oklahoma does not require deed witnesses.
  • Recording: Record with the county clerk of the county where the land lies. Oklahoma has 77 counties. A nonexempt deed must include the current notarized Oklahoma Attorney General land-ownership affidavit as an exhibit under 60 O.S. § 121(C); an exempt deed must identify the applicable exemption on its face.   • Transfer Tax / Recording Fees: Oklahoma documentary stamp tax remains in force. It was renumbered, not abolished. Look up the current 68 O.S. § 3201 rate and any § 3202 exemption. This packet does not include a stamp blank. Recording fees also apply.

Quitclaim Deed vs Warranty Deed in Oklahoma

An Oklahoma warranty deed uses "grant, bargain, sell and convey … and warrant the title" and imports the five covenants of 16 O.S. § 19. An Oklahoma quitclaim uses "quitclaim, grant, bargain, sell and convey" and carries no warranty. For an arm's-length sale, a warranty deed is normally used. A quitclaim is reserved for transfers where the parties accept the no-warranty risk.
