About this form
This is a no-fault divorce form for use within the State of Michigan (COMPLAINT FOR DIVORCE). Most courts will require that this form be completed and filed along with a Marital Settlement Agreement (Minor Children). Please note that in Paragraph 5 (Grounds for Divorce), the Plaintiff will need to specify grounds for divorce that are recognized as valid within the State of Michigan. Michigan law recognizes only the following grounds as sufficient for granting a no-fault divorce: A breakdown of the marriage relationship to the extent that the objects of matrimony have been destroyed, and no reasonable expectation exists that the marriage can be preserved.
Michigan generally requires 180 days of state residency and 10 days in the county before filing. A divorce with a dependent child under 18 generally cannot be finalized until six months after filing; a judge may shorten that wait to no less than 60 days for unusual hardship (MCL 552.9, MCL 552.9f). The FAQ below covers the details.

Michigan generally requires that at least one spouse has lived in the state for the 180 days immediately before filing and in the county of filing for the 10 days immediately before filing (MCL 552.9). If the breakdown occurred outside Michigan, one spouse must have lived in Michigan for one year (MCL 552.9e); additional conditions apply if the defendant was not domiciled in Michigan (MCL 552.9f).
Michigan is purely no-fault. The court may grant a divorce when the marriage relationship has broken down to the extent that the objects of matrimony are destroyed and there is no reasonable likelihood the marriage can be preserved (MCL 552.6). The complaint in this packet includes that ground.
When the case involves a dependent child under 18, Michigan courts generally cannot take proofs until six months after the complaint is filed. On a showing of unusual hardship or compelling necessity the court may take testimony after 60 days, but never sooner (MCL 552.9f). Court schedules vary by county.
