About this form

Before you file for divorce in Tennessee

This packet opens an uncontested no-fault divorce in Tennessee, where both spouses agree on the terms.

Tennessee is an agreed irreconcilable-differences state. Cases with a child under 18, in high school, or disabled use the official children packet, including the official Permanent Parenting Plan. Official packets tell customers to wait 90 days from filing. Those blank official forms are free at tncourts.gov. You are paying for current-edition packaging, the eligibility screen, the Filing & Finish Companion, and ILRG product support. That is not legal advice. The FAQ below covers the details.

The children packet also requires that one or both spouses lived in Tennessee with the children for at least the past six months, or that both spouses lived in Tennessee when they decided to divorce and the children have lived in Tennessee at least six months. File in Circuit, Chancery, or, in some counties, General Sessions. Ask the clerk which court hears divorces and file in only one court.

This packet uses only irreconcilable differences (T.C.A. § 36-4-101(a)(14)). Tennessee requires a written marital dissolution agreement and the official Permanent Parenting Plan. Both spouses must agree on parenting responsibilities and child support. Do not use these forms if either spouse is pregnant, or if there is real property, a business, or retirement other than Social Security. Do not use them if a child born during the marriage is not both spouses' child and was not adopted by both, if another case could affect custody or visitation, if either spouse is in a current case concerning the children, or if a non-parent holds a custody or visitation order.

Official packets tell every children-case customer to wait 90 days from filing before hearing, because the packet also covers children over 18 who remain in high school or are disabled (T.C.A. § 36-4-103(c)(1) is 90 days when there is an unmarried child under 18). Each parent must attend a parent educational seminar as soon as possible after filing (T.C.A. § 36-6-408). The seminar is at least four hours. The court may waive it for good cause. Failure to attend cannot by itself stop the divorce. You are not divorced until the judge signs the Final Decree and the clerk files it. Official papers also warn of a 30-day appeal period. Court schedules vary by county.

No. This packet is built for agreed cases only. Both spouses must agree on the marital dissolution agreement. If your spouse will contest the case, consult a Tennessee attorney.
