About this form
This agreement records the terms both spouses have agreed to, so the final decree can incorporate them.

MARITAL SETTLEMENT AGREEMENT — NO CHILDREN (PublicLegal-authored). Nebraska publishes no official statewide settlement form, so this is a PublicLegal-authored agreement (§ 42-366) written for the no-hearing path: both spouses sign under oath before a notary (§ 42-361(3)(b)).
What it covers: property and debt division, support waiver, tax terms, and the sworn certification that the marriage is irretrievably broken. Property terms bind unless unconscionable (§ 42-366(2)).
Signing does not divorce you. The judge must still sign the Decree (DC 6:4.6), sold separately. The court reviews the agreement before approving it.

Yes. Both spouses sign the PublicLegal-authored Marital Settlement Agreement under oath before a notary — Nebraska publishes no official statewide form (§ 42-366; § 42-361(3)(b) requires the under-oath written agreement for the no-hearing path). The court reviews it; property terms bind unless unconscionable (§ 42-366(2)). Signing the agreement does not divorce you — the judge does.
This form works when both spouses have reached full agreement. If you disagree about property, debts, custody, or support, mediation or attorney help is the safer path before filing.
No. ILRG provides self-help legal forms and information, not legal advice. Consult a Nebraska attorney if you have significant assets, debts, or any disagreement about the settlement terms.
