About this form
This packet opens an uncontested no-fault divorce in Illinois, where both spouses agree on the terms.
Illinois is a one-spouse petition state in Circuit Court. The no-fault ground is irreconcilable differences. Official statewide AOIC forms carry the petition and the Judgment. PublicLegal authors the path-cut instructions and the written 750 ILCS 5/502 agreement. This is not Joint Simplified Dissolution. The FAQ below covers the details.

PETITION FOR DIVORCE (NO CHILDREN UNDER 18). Official Form ATJ 103.4. This is the one-spouse start paper that opens an uncontested Illinois Circuit Court case. Official Judgment ATJ 104.4 stays in this packet.

The 24 packet documents listed on this page are included, delivered in Word and print-ready PDF formats. The packet centers on the Petition for Divorce that opens an uncontested no-fault case, plus the supporting filing documents and reference materials shown above.
One spouse must have been an Illinois resident, or stationed in Illinois in the armed services, for 90 days next preceding commencement of the action or the making of the finding (750 ILCS 5/401(a)). File in the Circuit Court of the county where you or your spouse lives (750 ILCS 5/104). If neither of you lives in the filing county, you must file a written venue motion with the petition and have it heard first. Confirm the county with the clerk. Statewide AOIC forms must be accepted in every circuit; some counties also want a local cover sheet.
This packet uses Illinois's only remaining ground: irreconcilable differences have caused the irretrievable breakdown of the marriage or civil union (750 ILCS 5/401(a)). One spouse files the official Petition for Divorce. This packet is not Joint Simplified Dissolution, which uses clerk-supplied forms and a separate eligibility statute (750 ILCS 5/452). Do not use these forms if either spouse is pregnant.
There is no statutory cooling-off period after filing. After summons service, the respondent has 30 days to file an Appearance and an Answer or Response. If the parties have lived separate and apart for a continuous 6 months immediately before judgment, irreconcilable differences are treated as proven (750 ILCS 5/401(a-5)); that is a presumption, not a filing wait. You are not divorced until the judge signs official ATJ 104.4 and the clerk enters it. Court schedules vary by county. In Cook County and some other counties the judge may require a hearing transcript.
No. This packet is built for uncontested cases where both spouses cooperate, usually by signing an Appearance and completing official ATJ 104.4 plus the official Certification Agreement. If your spouse will contest the case, consult an Illinois attorney.
No. ILRG provides self-help legal forms and information, not legal advice. Consult an Illinois attorney if you have significant property, retirement accounts, business interests, safety concerns, or any disagreement about terms.
