About this form
This packet opens an uncontested no-fault divorce in New York, where both spouses agree on the terms.
New York is a one-spouse Supreme Court divorce state. The sold ground is DRL § 170(7). Official UCS UD forms carry the summons, complaint, and Judgment. PublicLegal authors the path-cut cover and the written stipulation. The FAQ below covers the details.

New York does not have a six-month residency rule. One of the five DRL § 230 alternatives must be true. A one-year New York residence is enough only with a statutory nexus — the parties married in New York, lived in New York as spouses, or the cause occurred in New York. Without that nexus, either party must have been a New York resident for two continuous years. Both parties being New York residents at commencement can also suffice when the cause occurred in New York. File in Supreme Court. Venue is the county where either party lives, or if there are minor children, a county where one of those children lives (CPLR 515, eff. 2025-02-19). Confirm the county with the clerk.
This packet uses only DRL § 170(7): the relationship has broken down irretrievably for at least six months. That six months is the breakdown period, not a residency rule, and it must already have run before the sworn statement. One spouse files official UD papers. This packet is not the joint-divorce packet and not the free UCS DIY interview.
There is no statutory cooling-off period after filing. If the defendant signs official UD-7, the case may go on the uncontested calendar immediately. Otherwise wait 40 days after service before calendaring. Default still requires no answer: 20 days after personal delivery in New York, or 30 days otherwise. You are not divorced until the judge signs official UD-11. Court schedules vary by county.
No. This packet is built for uncontested cases where both spouses cooperate, usually by signing official UD-7. If your spouse will contest the case, consult a New York attorney.
No. ILRG provides self-help legal forms and information, not legal advice. Consult a New York attorney if you have significant property, retirement accounts, business interests, safety concerns, or any disagreement about terms.
