New York does not have a six-month residency rule. One of the five DRL § 230 alternatives must be true. A one-year New York residence is enough only with a statutory nexus — the parties married in New York, lived in New York as spouses, or the cause occurred in New York. Without that nexus, either party must have been a New York resident for two continuous years. Both parties being New York residents at commencement can also suffice when the cause occurred in New York. File in Supreme Court. Venue is the county where either party lives, or if there are minor children, a county where one of those children lives (CPLR 515, eff. 2025-02-19). Confirm the county with the clerk.
