Three points to understand before completing the packet.

Execute it correctly

The principal signs with two subscribing witnesses and a notary acknowledgment. Use one in-person ceremony if granting any Section 4 estate-changing authority. The included execution checklist walks through the ceremony; do not use remote witnesses for Section 4 grants.

Grant powers deliberately

Initial only the general subjects you want to grant. Trust, gift, survivorship, beneficiary, survivor-benefit, and disclaimer powers are separately elected and never preselected.

Support third-party and real-property use

Important information for the principal. This document gives the person you name as your agent significant authority over your property and financial affairs. The authority begins as soon as you validly sign. Because the power is durable, your later incapacity does not by itself end it, except as provided by Florida law. No estate-changing authority in Section 4 is granted unless you personally sign or initial next to that specific authority. This document does not grant health-care decision authority.

2. Effective date and durability

This power of attorney is effective immediately upon valid execution and is not conditioned on incapacity or another future event. It contains the statutory durability wording required by § 709.2104, Florida Statutes.

3. General property and financial authority

The principal initials each subject the agent may handle. A blank line withholds that authority; there is no single “grant all” election.

4. Authorities requiring a separate signature or initials

The form presents each estate-changing authority separately and leaves every choice blank. These include creating an inter vivos trust, certain trust changes, gifts, survivorship rights, beneficiary designations, waiver of survivor benefits, and disclaimers. If any of these powers is granted, the form directs the principal to execute in one in-person ceremony.

Frequently Asked Questions About Florida Power of Attorney Forms

No. Florida does not publish a statutory form for a financial power of attorney. This instrument is drafted to comply with the Florida Power of Attorney Act, Chapter 709, Part II. The separate agent’s affidavit included in the packet follows the statutory affidavit form in § 709.2119(2)(c).

It is exercisable when properly executed. Under § 709.2108, a Florida power of attorney signed after October 1, 2011 cannot be conditioned on a future date, event, or contingency, so this document is effective immediately rather than only after incapacity.

Durable means the power is not terminated merely because the principal later becomes incapacitated. The document contains the durability wording required by § 709.2104.

Section 709.2105(2) requires the principal’s signature, two subscribing witnesses, and acknowledgment before a notary public or another officer authorized under § 695.03. If you grant any Section 4 estate-changing authority, execute the document in one in-person ceremony because remotely witnessed execution makes those authorities ineffective under § 709.2202(6). Use the included execution checklist at the signing table.

Florida grants only authority specifically stated in the document; a general “do all acts” clause grants nothing. Section 709.2202 also requires the principal to sign or initial beside each estate-changing authority, including trust, gift, survivorship, beneficiary, survivor-benefit, and disclaimer powers.

A bank or another third party asked to accept a power of attorney may request an affidavit from the agent. The included companion document follows the statutory form in § 709.2119(2)(c). It supports the acceptance process but does not guarantee that every third party must accept the power.
